In Nepal, live donor organ transplantation is only 14 years old with the first successful kidney transplant made in 2008 and a successful liver and bone marrow transplant made in 2016. However, transplantation of cadaveric cornea dates back to 1998. There are still no cases of animal-to-human organ transplantation in Nepal. There are stringent laws to regulate human body organ transplantation in Nepal which are amended from time to time. However, there is a racket of human traffickers who lure rural (...) people from this low-income country into the illegal organ trade. Furthermore, there is a substantial lack of awareness of organ donation among the general public. This article focuses on the stipulations of ethical, legal, and practical issues of obtaining organs procured from living and brain-dead donors that support the process of transplantation in Nepal. In addition, the article also explores the legal and practical issues of organ trafficking and organ donation awareness in Nepal on the basis of factual data and findings from other studies. Consented autopsy is almost non-existent in the Middle-East where established social and cultural beliefs regarding the procedure might discourage family members from requesting a consented autopsy. Evidence suggests that new information is obtained from consented autopsies. It would not be in the best interest of medicine if social and cultural misconceptions succeed in erasing the existence of consented autopsies entirely.

Health care ethics is a sensitive domain, which if ignored, can lead to patient dissatisfaction, weakened doctor–patient interaction and episodes of violence. Little importance has been paid to medical ethics within undergraduate medical education in developing countries such as Pakistan. Three doctors in Pakistan are currently facing an official police complaint and arrest charges, following the death of a sanitary worker, who fell unconscious while cleaning a drain and was allegedly refused treatment as he was covered in sewage filth. The (...) medical license of the doctors in question should be cancelled, if found guilty following a thorough investigation into the case. The ‘right to life’ has been universally assured by all moral, cultural and legal codes and no society can ever argue against the sacredness of a human life. It is quite clear that the aforesaid doctors’ actions are not only against the core principles of the physicians’ code, but also go against the doctrine of human rights. If serious efforts on an urgent basis are not made by the regulatory and governing bodies, one can definitely expect similar incidents for at least a few more decades before any noticeable change is seen. The genome of two completely unrelated individuals is quite similar apart from minor variations called single nucleotide polymorphisms which contribute to the uniqueness of each and every person. These single nucleotide polymorphisms are of great interest clinically as they are useful in figuring out the susceptibility of certain individuals to particular diseases and for recognizing varied responses to pharmacological interventions. This gives rise to the idea of ‘personalized medicine’ as an exciting new therapeutic science in this genomic era. Personalized medicine (...) suggests a unique treatment strategy based on an individual’s genetic make-up. Its key principles revolve around applied pharmaco-genomics, pharmaco-kinetics and pharmaco-proteomics. Herein, the ethical and legal aspects of personalized medicine in a new genomic era are briefly addressed. The ultimate goal is to comprehensively recognize all relevant forms of genetic variation in each individual and be able to interpret this information in a clinically meaningful manner within the ambit of ethical and legal considerations. Abortion continues to be a moral and ethical dilemma in medicine. While abortions in general have always faced social stigmas, the abortion of fetuses with Down’s syndrome in particular remains the subject of debate across the globe. In India, under the Medical Termination of Pregnancy Act, abortion is legal under prescribed circumstances only till 20 weeks of gestation. Laws for abortion after 20 week of gestation are ill defined. In a recent ruling of the Supreme Court in India, a woman (...) was denied the right to abortion of her 26 week old fetus. With this ruling, India has joined the rest of the world in the debate surrounding abortion laws and the ethics of abortion. (shrink)

Being inherently different from any other lifesaving organ transplant, uterine transplantation does not aim at saving lives but supporting the possibility to generate life. Unlike the kidneys or the liver, the uterus is not specifically a vital organ. Given the non-lifesaving nature of this procedure, questions have been raised about its feasibility. The ethical dilemma revolves around whether it is worth placing two lives at risk related to surgery and immunosuppression, amongst others, to enable a woman with absolute uterine factor (...) infertility to experience the presence of an organ enabling childbirth. In the year 2000, the first uterine transplantation, albeit unsuccessful, was performed in Saudi Arabia from where it has spread to the rest of the world including Sweden, the United States and now recently India. The procedure is, however, still in the preclinical stages and several ethical, legal, social and religious concerns are yet to be addressed before it can be integrated into the clinical setting as standard of care for women with absolute uterine factor infertility. Em 25 de maio de 2020 um homem negro americano, chamado George Floyd, morreu após ser asfixiado por mais de oito minutos por um policial branco na cidade de Minneapolis, nos EUA. Violentos protestos se seguiram ao longo do país com cartazes contendo as últimas súplicas de Floyd: “I can’t breathe” (Eu não consigo respirar). Pouco tempo depois, ainda sob o calor dos horrores da hora, outro fato também vinculado ao acontecimento recém-referido roubou a cena e chamou a atenção (...) dos principais meios de comunicação ao redor do planeta: tratava-se de um casal branco americano de moradores de um bairro nobre, em frente ao jardim de sua mansão de dois andares, esbravejando contra um grupo de negros que se dirigia para um protesto e resolveu cortar caminho passando por entre os casarões do bairro onde se encontrava o referido casal. O “detalhe” marcante dessa demonstração gratuita de ódio por parte do casal branco é que, enquanto o homem portava um potente fuzil moderno e a mulher uma pistola automática, ambos apontavam as armas contra os transeuntes negros que tiveram a “audácia” de se deslocar por entre os casarões da elite americana. O mais absurdo da situação foi um momento de transtorno colérico do casal branco que em certa altura do descontrole chegou a apontar a arma um contra o outro, revelando o completo desvario em que ambos se encontravam [...]. The increased incidences of academic misconduct in universities are compromising the reputation of higher education in Australia and increasing the work of academics responsible for the delivery of quality learning outcomes to students. Confronted with increasing instances of academic dishonesty in university classrooms, universities play a pivotal role in ensuring their academic staff are well-equipped with academic integrity knowledge. It is therefore important to understand academic staff perspectives about the training their workplaces could provide them on academic integrity. Specifically, this (...) qualitative case study explores the opinions and perceptions of sessional or casual university academic staff on what content they would like to know about academic integrity, and how this knowledge could best be delivered to them. The study found that participants were genuinely interested in furthering their understanding of academic integrity issues, particularly in the areas of contract cheating, effective use of plagiarism detection tools, and developing a toolkit of skills that they could use to detect and deter plagiarism. In terms of the delivery of academic integrity training programs, webinars and orientation sessions were suggested as effective delivery mechanisms. Imparting knowledge about the content areas through the identified delivery mechanisms could enhance teaching faculty’s understanding of student academic dishonesty and how to curb this behaviour proactively. presente trabalho busca explicitar alguns elementos da concepção voltairiana da história (e do historiador). A intenção não é a de inventariar, segundo uma ordem cronológica, a formação de uma filosofia da história em Voltaire, mas tão somente apresentar uma face dessa gênese, a saber, a crítica à teologia da história, que se encontra embasando aquele ponto de vista. Não há dúvida de que o erro faz parte do homem. Assim como a superstição, o fanatismo, o ódio, o crime, a guerra (...) e todos os demais efeitos do erro. No entanto, à força de destruir o erro, a verdade foi cultivada. Com efeito, o combate ao erro é um impulsionador dos homens e semelhante guerra se passa na história: a história dos progressos do espírito. Não há uma condenação perpétua do homem à ignorância e, por isso mesmo, não faz sentido conceber a história a partir de uma redenção, que indica à humanidade sua incapacidade de encontrar, por si mesma, os caminhos da superação de seus erros. Uma história sem redenção; estamos diante de uma das ambições mais importantes do pensamento voltairiano. Com ela nasce o desejo de eliminar o miraculoso, o misterioso que envolve o entendimento da história, retirando-lhe a crença ingênua no fantástico, por um lado, e a névoa espessa que a culpa e a criminalidade original lhe impuseram, por outro. Industrial and infrastructural developments are sprawled around us; yet unemployment is on the increase. While financial institutions and government agencies take capricious interests and levies in businesses; the human community and environment are left out in tatters. The media (...) advertises business via any means possible, ignoring questions about moral values of individual persons in the society as well as companies that drive the economy. These happenings, no doubt, raise genuine cause for concern as it threatens African indigenous morality. This is a pointer to the fact that there is something lacking. That desideratum is a unifying business ethic. This paper is a research that attempts to fill that ethical gap. It is considered that the philosophical concept of Ubuntu – an African traditional philosophy of social existence is essential. It supports and encourages integral human development, and as such can serve as an ethical ideal in an ever-dynamic business operation in Africa. (shrink)

George Herbert Mead (1863-1931) had a powerful influence on the development of American pragmatism in the twentieth century. He also had a strong impact on the social sciences. This classic book represents Mead's philosophy of experience, so central to his outlook. The present as unique experience is the focus of this deep analysis of the basic structure of temporality and consciousness. Mead emphasizes the novel character of both the present and the past. Though science is predicated on the assumption (...) that the present is predictable based on a thorough knowledge of the past, the experience of the present, says Mead, is an utterly unique moment comparable to no other, and when it is past the novel character of that unique experience is irrevocable. The emergence of novelty within the perceived rational order of reality is the crux of the problem that Mead explores. The present, in his words, is "the emergent event . . . something which is more than the processes that have led up to it and which by its change, continuance, or disappearance, adds to later passages a content they would not otherwise have possessed." The present as "the seat of reality" heavily conditions our retrospective view of the past as much as it helps to shape the future. The novelty of every present experience causes us to reconstruct our preceding experiences to make sense of the past, which is naturally assumed to be the main cause of what we presently experience. Our perspective on reality is thus relative to the conditioning of each new event and it changes continuously as the effects of the present shift our view of the past and future. This emphasis on the integrative, holistic nature of reality, in which everything past, present, and future is a condition of everything else, makes Mead's philosophy highly relevant to today's scientific picture of a quantum universe, where chance and probability play a role in the emergence of reality. Also of great interest is the way in which he extends his basic analysis of temporal-spatial reality to the emergence of mind and consciousness as a natural development of the evolutionary process. This stimulating and provocative work attests to John Dewey's praise of Mead as "the most original mind in philosophy in America" of his generation. (shrink)

o presente ensaio traz uma breve reflexao sobre a perspectiva habermasiana de sistematlzacao do "mundo vital", examinada no quadro histórico da questao da "pós-modernidade". Esta trata da relacao, apontada por HABERMAS (03:t II), entre as esferas do "sistema" e do "mundo vital", aplicada em termos de uma teoria da sociedade que se coloca frente a ideia de uma "nova ordem mundial".

O presente trabalho tem como objetivo refletir sobre a educação escolar no sistema prisional contemporâneo. Destacando os marcos legais e documentos oficiais que expressam e orientam o direito à educação nestes espaços não formais. Pensar a educação neste contexto é destacar a importância da educação para o processo transformador do ser humano, ou seja, a educação tem a função de promover a reintegração social do sujeito em situação de privação de liberdade. Para o desenvolvimento deste trabalho temos como abordagem qualitativa, (...) com o suporte das pesquisas bibliográfica e documental. Portanto, promover a acessibilidade da pessoa privada de liberdade, é promover não só a reintegração social via a educação, como promover o exercício da cidadania independente do fato julgado. Nestes termos, a educação escolar no sistema prisional tem sido um desafio para a reintegração social da pessoa privada de liberdade na contemporaneidade. (shrink)

Aponta-se como o marxismo realiza a crítica aos pontos de partida e de chegada da Ciência da lógica, quais sejam, o pensamento sem pressupostos e o círculo auto-constituído da Lógica. Com isso, indica-se a diferença entre os modos hegeliano e marxista de conceber o enraizamento do conhecimento no processo de vida real. Discute-se ainda como István Mészáros realizou uma dura crítica à hipostasiação do método dialético em G. (...) Lukács, crítica esta que se apóia na rejeição de um método que deixa de prestar contas ao ser e que, por isso, acaba lidando com a identidade entre conhecimento e ser como uma mera postulação abstrata.: This paper discusses István Mészáros critique of Hegel’s Logic. We point out how Marxism criticizes the presuppositionless thinkingand self-constituted circle of reasoning of the Science of logic. We thereby show the difference between the Hegelian and Marxist ways of conceiving the rooting of knowledge in the process of real life. We also discuss how Mészáros made a scathing critique of the hypostatization of dialectical method in Lukács work. This critique is based on the rejection of a method that fails to be accountable to the real world and therefore ends up treating the identity of knowledge and being as a mere abstract postulation. The Archaeology of Semiotics and the social order of things is edited by George Nash and George Children and brings together 15 thought-provoking chapters from contributors around the world. A sequel to an earlier volume published in 1997, it tackles the problem of understanding how complex communities interact with landscape and shows how the rules concerning landscape constitute a recognised and readable grammar. The mechanisms underlying landscape grammar are both physical and mental, being based in part on the (...) mindset of the individual; the same landscape can thus evoke different meanings for different people and at different times. People's perception has greatly influenced the construction of landscapes over millennia but, until recently, the potential of this area has been largely untapped. Apart from chapters focusing solely upon human interaction with landscape, there are several which skilfully integrate artefacts and place with landscape (e.g. Gheorghiu and Sognnes). Other chapters look at the way people have marked the landscape through such mechanisms as rock-art (e.g. Clegg, Devereux, Estévez, Fossati, Kelleher and Skier). Rock-art establishes personal and communal identity in relation to landscape and it is clear that other forms of visual expression were in place which distinctively created special places within the landscape. Landscape constructs can bind cultures together; bringing the old ways of reading the landscape into contemporary life (e.g. Smiseth). Defining early and late prehistoric landscapes and segregating these into, say, mundane domestic and ritualised spaces rely on both clear and subtle archaeologies and in this volume distinct monument clustering and ritualised linearity are considered (e.g. Mason and Nash). A volume such as this cannot escape the influence of New World approaches, such as anthropology, and in many respects chapters by Bender, Muller and Merritt give context to other chapters within the book. Finally, one must consider text as a means of constructing landscape and this is considered by Heyd, who eloquently deconstructs the travel diary of a 17th century Japanese poet. This will be an important volume for archaeologists, landscape scholars and students. The many approaches used are tried and tested, forming an invaluable resource and not just another edited book.
